§ 52-42. Unlawful use.

  • (a)

    No person, other than town employees and those persons properly permitted pursuant to the provisions of subsection (b) of this section, shall be authorized to connect, turn on, turn off or disconnect any utility service offered by the town, or remove, replace or repair any equipment connected to any such utility service.

    (b)

    A licensed contractor or licensed plumber, whose business registration with the town pursuant to article II of chapter 10 is current, may be authorized to turn on or turn off water utility service to a town water utility customer's premises by accessing town water utility equipment or property for the sole purpose of repair or maintenance of the customer's water service line. To be so authorized, the licensed contractor or licensed plumber must apply for and obtain the appropriate permit from the utility billing department, and such permit shall provide that by applying for and obtaining said permit, the permittee and the water utility customer (and the property owner, if different from the water utility customer) acknowledge and agree that they are liable to the town for any and all damage or injury including, but not limited to, town equipment or property, resulting from activities conducted pursuant to the permit.
