§ 38-25. Management rights and responsibilities.

  • (a)

    The town government shall retain the right, in accordance with council policies to:

    (1)

    Set standards;

    (2)

    Exercise control and discretion over the town government and its operations;

    (3)

    Direct employees;

    (4)

    Relieve employees from duties because of lack of work;

    (5)

    Remove employees from duties because of other business related reasons;

    (6)

    Maintain the efficiency of the operation entrusted to the town government;

    (7)

    Contract or subcontract as is determined desirable by the town council;

    (8)

    Determine the methods, means, and personnel by which the various operations of the town government are to be conducted;

    (9)

    Take whatever actions may be necessary to carry out the functions and means of the town government; and

    (10)

    Maintain uninterrupted service to its citizens in normal and any emergency situations.

    (b)

    The language contained in subsection (a) of this section shall be incorporated in and made a part of any collective bargaining agreement agreed to by the parties.
